Key Instrument — ASIC Relief

The current relief is contained in:

ASIC Corporations (Financial Services Guide, General Advice Warning and Advertising Related Relief) Instrument 2025/234

(LI 2025/234)

This instrument (together with related amendments) modifies the operation of sections 941A–941C and 943J of the Corporations Act 2001.

LI 2025/234 consolidates and continues the relief previously provided by three separate instruments that were due to sunset on 1 October 2025:

  • ASIC Corporations (Advertising by Product Issuers) Instrument 2015/539
  • ASIC Corporations (General Advice Warning) Instrument 2015/540
  • ASIC Corporations (Financial Services Guides) Instrument 2015/541

What the Relief Allows

The instrument provides targeted relief in three areas:

1. Financial Services Guide (FSG) Relief

A providing entity (AFS licensee, corporate authorised representative, or authorised representative) may satisfy its FSG disclosure obligations under sections 941A–941C of the Corporations Act 2001 by publishing website disclosure information instead of providing a traditional FSG document. This relief applies when the entity provides financial product advice, or deals in a financial product for the purpose of implementing that advice.

The website disclosure information must contain the same statements and information required in an FSG under section 942B and must be publicly available on the entity's website by the time the FSG would otherwise be required. It must be readily accessible, not behind a paywall or login, and clearly state the date it was prepared or last updated. Each version must be retained for seven years.

2. General Advice Warning Relief

The instrument continues existing relief regarding general advice warning requirements, including modified delivery requirements for oral general advice (e.g., telephone conversations) and advertising contexts. When general advice is provided via telephone, the entity must inform the client that an FSG (or website disclosure information) exists and will be sent on request.

3. Advertising-Related Relief

The instrument continues relief concerning advertising of financial products, including modified requirements for general advice warnings that appear in advertisements published via billboards, posters, or in the media.

Important limitations

  • The FSG relief does not apply to execution-only dealing services (i.e., where dealing occurs without prior financial product advice).
  • Services such as claims handling and settling remain subject to standard FSG delivery requirements.
  • If a corporate authorised representative or authorised representative relies on the website disclosure exemption, the information must be available on that specific representative’s website.
  • This page constitutes our website disclosure information for the purposes of section 941C(5A) of the Corporations Act 2001 and LI 2025/234.

What Services We Provide

MyMoney® Marketplace operates a reverse marketplace model (Brief → Match → Pitch). Our services include:

  • Allowing Brief Owners to post a brief describing the general financial or professional service they are seeking.
  • Using our AI-enabled matching tools (“Intelligence Swarm”) to connect briefs with verified Providers who specialise in the relevant area(s).
  • Enabling Providers to submit proposals in response to briefs.
  • Providing tools (including our Transparent Box™ scoring framework) to help Brief Owners compare proposals on a general basis.

Important limitations of our service

  • We provide general information only. We do not provide personal financial product advice.
  • We do not assess your personal objectives, financial situation, or needs.
  • We do not recommend any specific Provider or proposal.
  • The proposals you receive are prepared by independent Providers. We are not responsible for the content, accuracy, or suitability of those proposals.
  • Our matching and scoring tools are for general informational and comparison purposes only. They involve an element of judgment and may not capture every relevant factor for your situation.
  • Any decision to engage a Provider is made solely by you. You should carefully consider the information provided and, where appropriate, seek personal advice from the Provider or another qualified professional before acting.

We do not hold ourselves out as providing personal advice, investment recommendations, or suitability assessments.

How We Are Remunerated

[Insert clear statement of the platform’s remuneration model. Examples below — replace with actual details.]

  • Brief Owners: Currently there is no charge to post a brief or receive proposals.
  • Providers: Providers may pay [describe fees — e.g., a subscription fee, a fee per qualified lead/brief received, a success fee upon engagement, or a combination]. Full details are available upon Provider registration or on request.
  • We may receive remuneration from Providers in connection with the platform. This does not influence the matching process or the content of proposals.

We do not receive commissions or other benefits from Providers that are contingent on you acquiring a specific financial product, except as disclosed above or in the proposal itself.

Where we have a relationship with a Provider that could reasonably be expected to influence the service we provide, we will disclose that relationship.

5

Relationships, Associations & Conflicts of Interest

  • Providers listed or matched on the platform are independent of Global Mutual Funds Pty Ltd unless otherwise disclosed.
  • We verify that Providers hold appropriate licences, registrations, insurance, and credentials relevant to their vertical before they can submit proposals. However, we do not guarantee the ongoing compliance or performance of any Provider.
  • We may have commercial relationships with some Providers (e.g., subscription or lead fees). These arrangements are disclosed where relevant and do not affect the general nature of the information we provide.
  • Our staff and representatives may hold interests in financial products or businesses. Any material conflicts are managed in accordance with our conflicts management policy.

We maintain a Conflicts of Interest Policy. A copy is available on request.
